General Terms and Conditions of Sale

ElectroCAD — AutoCAD plugin suite for electricians, designed in Switzerland.

1. Acceptance and scope

Les présentes Conditions Générales de Vente (ci-après « CGV ») régissent l'ensemble des relations contractuelles entre ElectroCAD (ci-après « l'Éditeur ») et toute personne physique ou morale (ci-après « le Client ») qui souscrit à un abonnement ou télécharge le logiciel. Le simple fait de créer un compte, de souscrire à un essai gratuit, ou de procéder à un paiement vaut acceptation pleine et entière des présentes CGV.

The Publisher reserves the right to amend the GTC at any time. Any substantial change is notified to the Client by email with thirty (30) days' notice before it takes effect. The applicable GTC are those published at electrocad.ch/cgv.

2. Description of the service

ElectroCAD est une suite de plugins logiciels destinés à AutoCAD 2025 et 2026 (Windows 10 et 11, 64 bits) pour la production de schémas, plans et planifications électriques. Elle se décompose en trois produits distribués sous forme d'abonnement : ElectroSchema (schémas électriques automatisés), ElectroCAD Tools (50 outils de productivité AutoCAD) et ElectroBlocs (bibliothèque de 1187 symboles IEC 60617).

The Publisher strives to maintain reasonable availability of the licensing and update service, without however guaranteeing one hundred percent availability. An offline grace period of fourteen (14) days in full mode plus seven (7) days in read-only mode allows the software to keep working even during occasional server unavailability.

3. Prices and billing

Current prices are published on the Pricing page. The three available packs are: Pack Essentiel (399 CHF/year, ElectroCAD Tools), Pack Pro (599 CHF/year, ElectroCAD Tools + ElectroBlocs) and Pack Ultimate (799 CHF/year, ElectroCAD Tools + ElectroBlocs + ElectroSchema). Prices shown are in Swiss francs (CHF) and exclusive of any applicable taxes.

The subscription is billed annually in advance. Payment is made by credit card via a secure payment provider. In the event of non-payment when due, the Publisher reserves the right to suspend access to the licenses after a formal notice has remained without effect for fifteen (15) days.

4. Term and renewal

The subscription is entered into for an initial term of one (1) year from the date of subscription. It renews automatically for successive one-year periods unless terminated by the Client at least thirty (30) days before the renewal date, by email to info@electrocad.ch or via the dashboard.

5. Free trial and money-back guarantee

The Client benefits from a free thirty (30) day trial, with no credit card required and no commitment. All features are accessible during this period.

For paid subscriptions, the Publisher applies a thirty (30) day money-back guarantee: the Client may request a full refund of their annual subscription within the first thirty days, without having to give a reason, by email to info@electrocad.ch.

6. License and activation

Each license entitles the Client to activate ElectroCAD on one (1) AutoCAD workstation identified by an HWID (a hardware fingerprint composed of four elements: hard drive, motherboard, machine identifier and Windows user SID). The Client may perform up to three (3) license transfers per month between workstations, from their dashboard.

The license is granted on a non-exclusive, non-transferable basis. Any resale, sub-licensing or redistribution is strictly prohibited.

7. Termination

The Client may cancel their subscription at any time from their dashboard. Cancellation takes effect at the end of the current period, with no pro-rata refund of amounts already paid (except under the 30-day guarantee). The Publisher may terminate the subscription in the event of a serious breach by the Client (non-payment, violation of the GTC, abusive use).

8. Intellectual property

ElectroCAD, its libraries, source code, documentation and all associated graphic elements remain the exclusive property of the Publisher. The Client holds only a non-exclusive, non-transferable right of use. The "ElectroCAD" trademark, logos and visual identities may not be used without prior written authorization.

The electrical schematics, plans and planning documents produced by the Client using ElectroCAD remain the full property of their authors. The Publisher claims no rights over the DWG files produced by users.

9. Limited warranties

The Publisher warrants that the software performs substantially in accordance with the documentation, under normal conditions of use on AutoCAD 2025 and 2026, Windows 10 and 11 (64-bit). No warranty is given as to the software's fitness for any particular purpose other than that described in the documentation.

10. Limitation of liability

Dans toute la mesure permise par le droit suisse, la responsabilité de l'Éditeur, tous chefs de préjudice confondus, est limitée au montant des sommes effectivement payées par le Client au titre de l'abonnement pendant les douze (12) mois précédant la survenance du dommage. L'Éditeur n'est en aucun cas responsable des dommages indirects, pertes de données, pertes d'exploitation ou pertes de chance.

11. Data protection (GDPR / Swiss FADP)

The Publisher processes the Client's personal data in accordance with the Privacy policy, in compliance with the General Data Protection Regulation (GDPR, EU 2016/679) and the Swiss Federal Act on Data Protection (FADP, SR 235.1) of 25 September 2020.

The Client has the right to access, rectify, erase, port and object to the processing of their data. Any request may be sent to info@electrocad.ch.

12. Force majeure

Neither party may be held liable for the non-performance of its obligations resulting from an event of force majeure as defined by Swiss law, in particular: natural disaster, armed conflict, widespread Internet network outage, or failure of a third-party provider (Autodesk, hosting provider, payment provider).

13. Governing law and jurisdiction

These General Terms and Conditions are governed by Swiss law, to the exclusion of conflict-of-law rules. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the ordinary courts of the canton of Valais (forum of Sion), subject to mandatory provisions in favour of consumers.
